Terms of Service.

These Terms of Service (“Terms”) govern your access to and use of Sprout, provided by Sprout Baby, LLC (“Sprout,” “we,” “us”), including our website, Sprout AI, and Sprout Closet (together, the “Service”). By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.

Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to create a Sprout account. You're responsible for the accuracy of the information you provide and for keeping your login credentials secure. A Sprout account represents a household (“family”) — the adults you add to it can see and edit the same family and child information, so only invite people you actually want to share that access with.

Sprout AI

Sprout AI uses an AI model to answer questions and generate content (including nursery design images) based on information you provide. Its responses can be incomplete, out of date, or simply wrong. Sprout AI is not a medical provider and nothing it says is medical advice. Always consult a qualified doctor, midwife, or other healthcare professional with questions about your pregnancy or your child's health. Don't use Sprout AI as a substitute for professional medical, legal, or financial advice.

Subscriptions and billing

Sprout AI plans and Sprout Closet boxes are billed on a recurring basis (typically monthly) through our payment processor, Stripe, until you cancel. A Sprout Closet box bills a fixed base price for a standard box, plus any additional charge for a pricier selection, à-la-carte pick, or accepted add-on you choose for that cycle. By subscribing, you authorize us to charge your payment method each billing period. You can cancel a subscription at any time from your account; cancellation stops future charges but doesn't refund amounts already billed, except where required by law.

We may change plan pricing or what a standard box includes going forward. If we do, we'll show the updated price or contents before it applies to your next cycle.

Sprout Closet items

Clothing items included in your Sprout Closet box are yours to keep — Sprout Closet is a sizing subscription, not a rental. We currently don't offer a return or exchange process for items already shipped to you; contact us if something arrived damaged or incorrect.

Content you provide

You retain ownership of anything you upload to Sprout, including room photos for Nursery Designer and messages you send Sprout AI. You grant us a license to store, process, and display that content back to you (and to other adults in your family account) as needed to provide the Service — for example, sending your room photo to our AI model provider to generate a redesign. We don't use your uploaded photos or conversations to train AI models or for any purpose beyond providing the Service to you.

You're responsible for what you upload. Don't upload content you don't have the right to share, or that's illegal, infringing, or harmful.

Acceptable use

You agree not to:

• Use the Service for any unlawful purpose, or in a way that violates anyone else's rights
• Attempt to access another family's account or data without authorization
• Reverse-engineer, scrape, or interfere with the Service or its underlying systems
• Use Sprout AI to generate content that's illegal, harmful, or abusive
• Resell or commercially exploit the Service without our written permission

We may suspend or terminate accounts that violate these Terms.

Third-party services

The Service relies on third parties to function — Google, Facebook, and Microsoft for sign-in, OpenAI to power Sprout AI, Stripe to process payments, and Shippo and its carriers to ship Sprout Closet boxes. Your use of those integrations is also subject to those providers' own terms. See our Privacy Policy for more on how we share information with them.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or that Sprout AI's output will be accurate or appropriate for your situation.

Limitation of liability

To the fullest extent permitted by law, Sprout won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.

Termination

You can stop using the Service and cancel your subscriptions at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service, with notice where reasonably practical.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the “Last updated” date above and, where appropriate, notify you directly. Continuing to use the Service after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law principles.
